Sex and gender reassignment discrimination in the provision of services
The Sex Discrimination (Amendment of Legislation) Regulations 2008 makes illegal:
- indirect discrimination in provision of services on grounds of sex (direct discrimination has always been unlawful)
- direct discrimination in provision of services on grounds of gender reassignment
- direct and indirect discrimination in provision of services against a woman on the basis of pregnancy or because she has given birth within the previous 26 weeks
- harassment in provision of services or premises on the basis of sex
Practice should ensure that they do not discriminate in the provision of their services and are advised to implement an Equal Opportunities/Anti-Discrimination (Service Provision) Policy - a downloadable draft policy is in the Members Library -
The Equality Act 2006 created a duty on public authorities (the 'Gender Equality Duty') to promote equality of opportunity between men and women and to prohibit sex discrimination in the workplace -
